1. Content

(1) These General Terms and Conditions of Use govern the relationship between La Résidence Hôtelière Hurlevent (the Provider) and the user of the website (the User). These terms and conditions constitute a contract between the parties, who acknowledge and accept them in their entirety by using the website.

(2) The version of the General Terms and Conditions of Use applicable to the User is the one in effect at the time the User accesses the Provider's online portal. Only the currently applicable version will be visible on the portal. It will remain accessible for consultation for the entire duration of its validity. Previous versions of the General Terms and Conditions of Use are not retained by the Provider. The Provider suggests that the User print a copy or save them to their computer.

2. Purpose

(1) The Provider's objective is to offer an online portal where Users can obtain information about the hotel. Use of the site is free for the User.

(2) The Provider allows Users, via the portal, to request a suite reservation.

3. Suites

(1) On the Provider's online portal, the User can view the description, price, and photos of the suites.

(2) The User can reserve a suite by specifying arrival and departure dates and the number of people. The User agrees to provide accurate information.

(3) The Provider reserves the right, at its sole discretion, to refuse any User request without any compensation.

(4) The suite reservation is only effective after payment of the deposit or the full amount.

(5) Payment of the deposit by the User constitutes acceptance of the internal regulations available on the portal. Following payment of the deposit, the Supplier commits to renting the suite for the dates specified in the invoice, except in cases of force majeure.

(6) The deposit is non-refundable, except in cases of force majeure, such as hurricanes, earthquakes, etc.

4. Rights and Obligations of the Supplier

(1) The Supplier will make reasonable efforts to ensure that the information presented on the portal corresponds as accurately as possible to reality.

(2) The Supplier shall not be held liable under any circumstances for any information that is not up-to-date or in the event of an incomplete translation.

(3) The Provider will make reasonable efforts to keep the website technically up-to-date.

5. Website Ownership

(1) The Provider is the exclusive owner of the residence-hoteliere-hurlevent.com portal and its content. Reproduction of the website, in whole or in part, by copying the text, graphics, or designs is strictly prohibited.

6. Tenant Information

(1) Tenants are required to enter and record accurate and truthful information.

(2) Emails sent through the Provider's booking system must only contain serious booking requests. Misuse of the system is prohibited.

(3) The Provider does not perform any identity verification.

(4) The Provider complies with the provisions of the French Data Protection Act of 6 January 1978. For more information, please consult the Personal Data Management Policy.

7. Unauthorized Uses

No Tenant or third party is authorized to:

(a) use the content of the residence-hoteliere-hurlevent.com website, including the database, by any automated or manual means. In particular, it is prohibited to copy, distribute, reproduce, process, translate, decompile, or grant any right to use the data or otherwise make the content available to the public, whether intentionally or unintentionally, in whole or in part;

(b) use any automated process or mechanism, such as web crawlers or other similar tools, to monitor the content of the site;

(c) use the site for purposes other than searching for and requesting vacation rentals or spa services;

(d) transmit, send, or otherwise upload any content or program that, due to its size or nature, could damage the Provider's computer system, send such content or program to the site, or use any computer hardware or software that has harmful content or contains harmful programs;

12. Right of Withdrawal

(1) The User is informed that, pursuant to Article L. 221-18 of the French Consumer Code, the Services offered on the Website by La Résidence Hôtelière Hurlevent, either on its own behalf or on behalf of its Partners, are not subject to the right of withdrawal provided for in Articles L. 121-20 et seq. of the French Consumer Code concerning distance selling.

(2) Consequently, Services booked on the Website are exclusively subject to the cancellation and modification conditions set forth herein and/or in the applicable Partner Specific Terms and Conditions.

13. Mediator

(1) The contract between La Résidence Hôtelière Hurlevent and the User is expressly governed by French law.

(2) Any dispute relating to its interpretation and/or performance shall be subject to the jurisdiction of the French courts.
